Internet Advertising Terms and Conditions
1 These Terms and Conditions shall constitute a contract between the Advertiser (customer) and the Website Provider (Cow Horses And More, LLC, aka CHAM), to place advertising on the CowHorsesAndMore.COM internet world wide web site. NO AGREEMENT OR UNDERSTANDING NOT SPECIFIED HEREIN WILL BE BINDING ON EITHER PARTY.
2 All copy and instructions must be submitted at time of order. Website Provider will assume no responsibility for the text, photographic submissions, or other information other than error in advertising set up by Website Provider. Advertiser agrees to indemnify and hold the Website Provider harmless from any intellectual property copyright and trademark infringement based on material furnished to the Website Provider in connection with advertisement by the Advertiser.
3 Advertiser agrees that the description of the classification chosen identifies the classification category in which the Advertiser wants advertisement to be placed.
4 All orders must be prepaid for the designated time period that the ad is to be run. A valid Credit Card (within the constraints of the type credit cards offered to be used for payment) number with valid expiration date and authorization at time of order will be charged according to specified term of advertising. In the event of nonpayment or cancellation of payment for any undisclosed reason, the web advertising will be deactivated from the Internet and the entire amount of any unpaid balance shall immediately become due and payable. Website Provider will then reserve the right to charge the balance due on Advertiser's charge card on file including a 10% fee for processing. A deactivated account may be charged a $20.00 reactivation fee in order to reestablish advertisement service.
5 In accordance with this contract, if Website Provider has failed to meet Advertiser expectations or violated this Agreement, damages would be limited to and only to the amount of unused advertising time. It is understood that there will be no compensation for the loss of property or profit. Should legal action become necessary, the venue to hear this matter will be held in the City of Fort Collins, Colorado.
6 Website Provider shall have the right to disclose all information obtained from Advertiser to law enforcement agencies upon receipt of suitable subpoena or other legal document requesting same and duly executed and served in a recognized judicial manner.
7 The Website Provider has the unilateral right to change ad rates at any time. However, no ad rate changes will take effect on any currently posted ads until the originally contracted time limit has expired; e.g., if Advertiser placed ad for one month and ad rate changed during 3rd week of that month, new ad rate would not be effective until/unless Advertiser renewed the ad at the end of that month.
8 Website Provider reserves the right to reject any advertising matter which it deems objectionable. Advertiser is responsible for all corrections such as line, logo, border and photo changes on their ad. Website Provider will not be held responsible for copy changes given by Advertiser over the telephone or thru email messages.
9 Either party may terminate this contract by written notice, provided written notice is received by either party within 3 days of this order date. Cancellation by Advertiser after 3 days of the order date will result in forfeiture of any payments, which at the discretion of the Website Provider, will be applied to web page set up, processing, and bookkeeping. At the time Advertiser no longer needs internet advertising service, written notice (may be by US postal mail or electronic email) shall be made to Website Provider and the advertisement will be removed from the website. Advertiser should not consider their email notification confirmed until a response email is received from Website Provider.
10 This agreement with Advertiser is binding upon all parties, including heirs, assignees, and successors in interest, and shall honor the obligation to pay any balance outstanding in this agreement.
